GENERAL TERMS AND CONDITIONS OF CONTRACT REVOLTA CYCLING TOURS

1. Definitions For the purposes of this document:

  • “Revolta Cycling Tours”, “Revolta”, “the company” or “we” / “our”: refers to the holder of the business activity (sole trader / self-employed individual) operating under the trade name “Revolta Cycling Tours”, whose legal identification details appear in the booking confirmation and in the Standard Information Form provided on a pre-contractual basis. Depending on the case, it will act as organiser of package travel and/or as retailer, as indicated in the booking confirmation.
  • “Client”, “participant” or “traveller”: the person who contracts our services, individually or as part of a group.
  • “Booking”: formal request for services made by the client and confirmed in writing by Revolta Cycling Tours.
  • “Travel credit”: personal and non-transferable balance, not redeemable for cash, usable for future bookings with a maximum validity of 18 months from its issue (without prejudice to any mandatory rights that may apply).
  • “In writing”: communication by email or formal letter providing reliable evidence.
  • “Package travel contract” and “linked travel arrangements”: as defined in the applicable consumer legislation.
  • “Force majeure”: unavoidable and extraordinary circumstances beyond the control of the party invoking them, the consequences of which could not have been avoided even if all reasonable measures had been taken. This includes, by way of example, natural disasters, serious disturbances of public order, epidemics accompanied by restrictive measures, or decisions of public authorities that objectively prevent the provision of the trip. Events attributable to the organiser and the ordinary risks inherent in the activity do not constitute force majeure.

2. Capacity to contract and minimum age

In order to contract with Revolta Cycling Tours, the client must be at least 18 years old, have legal capacity to contract and act on their own behalf. We do not provide services to minors. In group bookings, the person making the booking declares and warrants that all participants are over 18 years of age.

3. Scope of application and nature of the service

3.1. The services offered by Revolta Cycling Tours are, as a general rule, regarded as package travel in accordance with Royal Legislative Decree 1/2007.

3.2. These conditions apply to package travel organised by Revolta Cycling Tours. If only a single standalone service is contracted, it will not be considered package travel and will be governed by the general applicable legislation and by these conditions where applicable.

4. Essential pre-contractual information

The trip description and the Standard Information Form contain the essential precontractual information required by the applicable regulations (main characteristics of the trip, itinerary, level of difficulty, services included and not included, price, minimum group sizes, accommodation, transfers, insurance and other relevant data). The technical metrics (distances, elevation gains, estimated times, etc.) are approximate and may be adjusted for safety, weather or operational reasons.

5. Client suitability, equipment and risks

The client declares that their physical and technical condition is suitable for the contracted trip and that they do not suffer from any limitations that may pose a risk to themselves or to third parties.

Tours are intended exclusively for cycling participants. Non-cycling companions are not permitted unless expressly stated in the tour factsheet or booking confirmation.

They must use, as a minimum, an approved helmet, a bicycle in good condition and appropriate clothing. It is recommended to have a GPS device to follow the tracks; where appropriate, we may provide one on loan, subject to availability, and it must be returned in good condition (save for normal wear and tear).

The routes run mainly along roads open to traffic, so the client must at all times comply with traffic regulations and follow the instructions of the Revolta team.

The client acknowledges and accepts that the practice of cycling entails inherent risks that cannot be completely eliminated and which may cause injury, including serious injury and even death, without this implying a waiver of their rights as a consumer or an exemption from the legal liability corresponding to Revolta Cycling Tours or its suppliers.

6. Dietary requirements (allergies/intolerances)

The client must notify in writing, with sufficient advance notice, any relevant food allergy or intolerance. Without such prior notification it will not be possible to guarantee adaptations or the absence of allergens. The company shall not be liable for reactions arising from information that has not been provided, is incomplete or is supplied late.

The company will manage the information provided with the catering establishments, and there may always be a residual risk of traces, which the client accepts, and they must carry their emergency medication where applicable. Health data will be processed solely in order to protect their food safety, in accordance with our Privacy Policy.

7. Own bicycles and basic assistance

The client’s bicycle must be in perfect condition. Any minor adjustments that may be carried out by Revolta staff are provided as a courtesy and do not constitute a workshop service or technical inspection. The client remains responsible for the condition and safety of their bicycle. Revolta will only be liable for damage caused by demonstrable negligence of its staff in such adjustments.

8. Rental bicycles included in the package

The bicycles and accessories are provided through subcontracted suppliers and form part of the package travel. Revolta is liable to the client for their proper provision and, when they are not fit for purpose for reasons not attributable to the client, for arranging repair or replacement at no cost within a reasonable period.

A security guarantee may be required (for example, a card pre-authorisation). The client shall use the bicycle with due care and with appropriate safety equipment and shall be liable for any damage, loss, theft or delay attributable to them due to negligence or breach, normal wear and tear being excluded.

Where applicable, any charges shall be limited to justified costs of repair or replacement, supported by evidence.

Revolta may share the data strictly necessary with the suppliers in order to manage delivery and return of the equipment, in accordance with the Privacy Policy.

9. Role of the tour leader and navigation by track

The tour leader provides support and coordination of the group (logistics, orientation, liaising with suppliers, minor incidents). This does not entail permanent individual supervision, or medical, rescue or professional workshop services.

Revolta Cycling Tours provides tracks and technical descriptions; the client declares that they have sufficient experience to follow the route by their own means and to orient themselves to the end even without the tour leader, using their GPS device, without prejudice to our duties of assistance (clause 11) and exclusively for safety reasons.

10. Conduct and traffic rules

10.1. Duties of the client: to follow the organisational and safety instructions of the team, to comply with traffic regulations and to maintain safe and respectful behaviour towards the group, the local population and the environment.

10.2. Third-party rules: the client shall comply with the access and use rules imposed by third parties (venues, wineries, museums, suppliers). Non-compliance may result in denial of access or exclusion without the right to a refund.

10.3. Exclusion for serious breach: Revolta Cycling Tours may exclude, without refund, any client whose conduct endangers safety or prevents the normal development of the trip, without prejudice to the duties of assistance (clause 11).

11. Duty of assistance during the trip

Revolta Cycling Tours shall provide the traveller with appropriate assistance without undue delay in the event of difficulties during the trip.

Where the return as planned becomes impossible due to unavoidable and extraordinary circumstances, Revolta shall bear, at no cost to the traveller, the necessary accommodation for a maximum of three nights per traveller, in accommodation of equivalent category, and shall arrange the return at no additional cost.

If the difficulty has been caused intentionally or through the traveller’s negligence, Revolta may charge a fee for the assistance provided.

For safety, weather or operational reasons, Revolta may reasonably adjust the itinerary, seeking to maintain the equivalence of the services. If the change is substantial before the start of the trip, clause 19 shall apply.

12. Booking, payments and confirmation

12.1. For bookings made 61 days or more in advance, a deposit of 30% of the total price is required to formalize the reservation. The traveler expressly authorizes the remaining 70% balance to be automatically charged to the same payment card 60 days prior to the tour start date.

12.2. Bookings made 60 days or less before the tour start date require 100% payment of the price at the time of booking.

12.3. The booking is considered confirmed once Revolta Cycling Tours sends the confirmation on a durable medium.

12.4. Non-payment entitles Revolta to terminate the booking. If, for any reason (including failure of the automatic charge), the total price has not been paid in full 60 days prior to the start date, and the traveler fails to rectify the payment within 48 hours of the error notification, the booking will be deemed cancelled by the traveler. In this event, no refunds shall be issued, and all amounts previously paid shall be non-refundable.

12.5. Any subsequent extension shall require the client’s acceptance and payment of the corresponding cost.

13. Price, currency and included items

The price is stated and charged in euros (EUR, €) and is guaranteed upon confirmation of the booking, except as provided in clause 14 when the contract constitutes package travel. The client shall bear any bank or foreign exchange fees charged by their financial institution.

The included services are governed by the tour information sheet in force on the booking date. Revolta may replace services with equivalent ones for operational reasons. All items not expressly indicated as included are excluded (see clause 15).

14. Price revision

The price may only be changed due to variations in exchange rates, in the cost of transport resulting from fuel, or in applicable taxes and charges. Any revision shall be notified at least 20 days before the start of the trip. If the increase exceeds 8%, the traveller may terminate the contract without penalty. The traveller shall be entitled to a price reduction when the aforementioned costs decrease, and Revolta may deduct its actual administrative expenses.

15. Services not included

The contracted services are exclusively those indicated in the Trip Sheet/Programme and in the Booking Confirmation. Any other information is for guidance only.

The following are not included, unless expressly stated:

• Air tickets and transport to and from the start/end points of the trip.

• Transfers outside the scheduled times.

• Medical or cancellation insurance.

• Services before or after the official dates.

• Meals, drinks or other consumptions not indicated.

• Activities not organised by Revolta.

• Bicycle rental and personal equipment.

• Complex repairs or damaged personal components.

• Personal expenses. • Local taxes not indicated.

• Tips.

• Subsequent authorised charges (clause 12.5).

• Anything not expressly included in the information sheet for each tour.

16. Minimum number of participants

The minimum number is 4 participants. If this number is not reached, the trip may be cancelled with the following notice periods:

  • 20 calendar days for trips of more than 6 days.
  • 7 calendar days for trips of 2 to 6 days.
  • 48 hours for trips of less than 2 days.

The traveller shall be entitled to a full refund without additional compensation.

17. Shared room accommodation and single supplement

17.1. If an individual client requests to share a room, efforts will be made to allocate them a roommate, preferably of the same sex if so requested.

17.2. If it is not possible to pair them up, the single occupancy supplement will apply.

17.3. The shared room option is not an obligation as to result and does not form an essential part of the package.

18. No right of withdrawal

As these are package trips with specific dates, the 14-day right of withdrawal applicable to distance purchases does not apply. Revolta’s cancellation policy applicable to the customer and the rights of termination provided for in the package travel regulations shall apply.

19. Changes before departure

If, before the start, a substantial modification proves necessary, the client may accept the change, choose another equivalent/superior trip, or terminate without penalty with a full refund.

20. Cancellation by the traveller

20.1. Cancellation must be communicated in writing to Revolta Cycling Tours. The effective date of cancellation shall be the date on which the email is received by Revolta.

20.2. Provided that the traveler is up to date with all payments at the time of cancellation, Revolta Cycling Tours will apply the penalty indicated in the table below, calculated on the total tour price per person.

After applying said penalty, Revolta will refund the remaining balance of the amount paid by the traveler. If the penalty is equal to or greater than the amount already paid, no refund shall be issued.

If there is any overdue or unpaid amount (including the balance due 60 days before the tour start date), Clause 12.4 shall apply, and no refund will be provided.

To this effect, should the automatic charge on day 60 fail, the traveler will only be considered up to date with payments if the payment is successfully rectified within the 48-hour period specified in Clause 12.4.

20.3. There will be no refunds for unused services, late arrivals, early departures or exclusion due to breach of the rules.

20.4. The traveller may transfer their place to a third party who meets the requirements, by giving 7 days’ notice and assuming any change costs.

21. No-show and documentation

A no-show is deemed to be failure to appear at the start of the trip or for included services for reasons attributable to the client (invalid documentation, denied boarding, missed flights, personal delays, sanctions). A no-show does not give rise to any refund.

22. Cancellation or modification by the company (no force majeure)

This covers safety- or operations-related reasons that do not constitute force majeure, instructions from an authority that do not reach that threshold, and an insufficient number of participants.

a) Before the start: the client may choose between a full refund or an appropriate alternative.

b) After the start: if the modification prevents continuation on equivalent terms, the client shall be entitled to a proportional reduction in the price or to terminate the outstanding part.

c) Expenses for external services contracted on their own account without prior authorisation will not be borne.

d) The assistance obligations in clause 11 apply.

23. Force majeure

Before the start: if unavoidable and extraordinary circumstances arise which significantly affect the performance of the trip or the transport to the destination, the contract may be cancelled without penalty and with a full refund within a maximum of 14 days.

During the trip:

(i) there will be no refund for services already provided;

(ii) appropriate alternatives will be offered, where possible, at no extra charge;

(iii) if this is not possible, a reduction or proportional refund will be made. No compensation for damages shall be payable when the lack of conformity is due to such circumstances, without prejudice to any mandatory rights that may apply.

24. Insurance

Revolta Cycling Tours has civil liability insurance in accordance with the applicable regulations. It is recommended that the client take out travel medical insurance and, where appropriate, cancellation insurance. Unless expressly included in the information sheet or booking confirmation, medical, evacuation, rescue and repatriation expenses shall be borne by the client, without prejudice to the assistance provided for in clause 11.

25. Liability, third parties and discretionary activities

a). Package travel: Revolta is liable for the proper performance of the contract, regardless of the involvement of suppliers. Liability for personal injury caused by negligence of the organiser or suppliers is neither limited nor excluded.

b). Intermediation outside the package: where we act solely as intermediaries in optional services, these are governed by the provider’s terms and conditions. Revolta is liable for its diligence in the intermediation, not for the actual performance.

c). Courtesy activities: activities that are not advertised do not form an essential part of the package. Their omission does not give rise to any right to a reduction or compensation, unless they are expressly integrated into the contract.

26. Insolvency protection

Where the contracted service qualifies as package travel, Revolta Cycling Tours provides protection against insolvency that guarantees the reimbursement of all payments made and, if transport is included, the repatriation of travellers, in accordance with current regulations.

The details of the entity providing such protection are as follows:

27. Use of image

During the trip, the team may take photographs or videos for promotional purposes only if the traveller has given express consent. Once consent has been given, Revolta may use the image without geographical or time limitation and without compensation, and such consent may be withdrawn at any time for future uses. Revolta may use images submitted by third parties provided that they hold the necessary rights and there is consent from the traveller whenever they are identifiable.

28. Data protection

Revolta Cycling Tours is the data controller for the data provided in order to manage the booking and perform the trip. The data may be communicated to those suppliers strictly necessary for the provision of the service. Detailed information is set out in the Privacy Policy published on our website.

29. Electronic contracting

Before completing the purchase, the website provides clear information on:

(i) the steps in the process;

(ii) the means for identifying and correcting errors;

(iii) the languages available; (iv) whether the contract is filed and accessible.

The confirmation button will clearly indicate the obligation to pay. Once the purchase has been completed, confirmation will be sent on a durable medium with a summary of the contract and a copy of the conditions.

30. Complaints

Official complaint forms for Catalonia are available to the client on request. The client may exercise the legal remedies that correspond.

31. Limitation period

Actions arising from the package travel contract shall become time-barred two years after the date of return.

32. Applicable law and jurisdiction

Spanish law applies. If the client acts as a consumer, the courts of their place of residence shall have jurisdiction. In all other cases, the parties submit to the courts of Tortosa (Tarragona).
